Last Updated: September 2026 | General Construction & Contracting Terms
1. General Scope
These Terms of Service govern all quotations, construction contracts, alteration works, roofing, tiling, painting, and maintenance services provided by Lincorn Construction to clients across Pretoria and the Gauteng Province.
2. Quotations & Validity
- All initial on-site inspections and estimates in Pretoria and Gauteng are issued on a free, no-obligation basis unless otherwise stated.
- Written quotations and Bills of Quantities (BOQ) remain valid for thirty (30) calendar days from the date of issue, subject to material supplier price fluctuations.
- Any variations, additions, or modifications requested by the client after quotation acceptance will be quoted and agreed upon in writing before work commences.
3. Payment Terms & Milestones
To protect both client and contractor, construction works are billed on a milestone progress schedule:
- An initial commitment deposit is required prior to site establishment and material procurement.
- Interim milestone payments are tied directly to verifiable physical stages (e.g. foundation slab, wall height, roof trusses/covering, plaster and tiling).
- A final retention balance is payable upon practical completion, joint snag-list inspection, and client sign-off.
4. Materials & Workmanship Guarantee
- All structural building supplies, concrete, rebar, timber, and masonry products are sourced in compliance with South African Bureau of Standards (SABS) requirements.
- We provide a 100% workmanship warranty covering defects arising from artisan execution for a specified period detailed in your project contract.
- Waterproofing and roof repairs carry written performance guarantees against water ingress, provided structural alterations are not undertaken by third parties.
5. Site Access & Safety
- The client agrees to provide safe, unimpeded access to the designated property and site area for the duration of the agreed working hours (Monday to Saturday).
- Lincorn Construction enforces strict Occupational Health and Safety (OHS) regulations on all active job sites, and unauthorized personnel must not enter active construction zones without supervision.
6. Governing Law
These terms and any contracts entered into with Lincorn Construction shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Any dispute shall be resolved through good-faith negotiation or through the relevant South African legal jurisdiction.
